Enterprise Stability Partners LLC
Last updated October 20, 2026
These Terms of Use & Disclosures govern your access to and use of https://espdiagnostic.com and any related Enterprise Stability Partners landing page, campaign page, form, scheduling page, or other online property operated by or on behalf of ESP that links to these Terms. The pages are operated by Enterprise Stability Partners, LLC, also referred to in marketing materials as “Enterprise Stability Partners” or “ES Partners” (collectively, “ESP,” “we,” “us,” or “our”).
By accessing or using the website or related marketing pages, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the pages. These Terms apply only to public website use, lead-generation and contact forms, campaign and landing pages, scheduling functions, and related pre-engagement communications. A formal diagnostic, advisory, implementation, or other professional engagement requires a separate written agreement.
1. Our Marketing Services
ESP’s marketing pages provide general information about ESP, its diagnostic-led approach, educational materials, and ways to request information or schedule a preliminary conversation. The pages may also provide forms, scheduling tools, email or SMS communications, and links to third-party services.
ESP may change, suspend, or discontinue any public page, feature, or item of content at any time. Nothing on a marketing page obligates ESP to accept a prospective client, provide a diagnostic, enter into an engagement, or offer any particular service or strategy.
2. No Client Relationship or Professional Advice
Website content and preliminary communications are provided for general educational and informational purposes. Accessing a marketing page, submitting a form, scheduling a meeting, receiving educational content, or participating in a complimentary preliminary conversation does not create a client, fiduciary, advisory, agency, or other professional relationship with ESP or any professional associated with ESP.
The public pages do not provide individualized legal, tax, accounting, investment, securities, insurance, valuation, or financial advice. Do not make a legal, tax, financial, investment, insurance, succession, valuation, or business decision solely on the basis of public website content. A formal engagement and appropriate review of relevant facts and documents are required before ESP provides engagement-specific findings or recommendations.
Descriptions of potential tax savings, preserved capital, business value, liquidity, risk reduction, succession outcomes, or other opportunities are illustrative and are not promises or guarantees. Actual findings and results depend on the facts, records, assumptions, market conditions, professional analysis, and implementation decisions applicable to each matter.
3. Eligibility and Authority
You must be at least 18 years old to use the marketing pages or consent to receive ESP marketing communications. If you use the pages on behalf of a company or other organization, you represent that you have authority to provide the submitted information and to act for that organization in connection with the inquiry.
4. Intellectual Property Rights
The marketing pages and their content, including text, graphics, designs, photographs, video, audio, downloads, logos, names, marks, scoring concepts, diagnostic terminology, frameworks, and other materials, are owned by or licensed to ESP and are protected by applicable intellectual-property laws.
ESP grants you a limited, revocable, nonexclusive, nontransferable license to access and use the public marketing pages for your personal or internal business evaluation of ESP’s services. You may not copy, reproduce, republish, distribute, sell, license, modify, create derivative works from, reverse engineer, scrape, or commercially exploit ESP content without prior written permission, except as expressly permitted by law.
Enterprise Stability Partners and other names, logos, service names, diagnostic names, indices, and related marks displayed on the pages may be trademarks or service marks of ESP or their respective owners. No right to use a mark is granted by these Terms.
5. Acceptable Use
You may not use the marketing pages to:
- Violate a law, regulation, court order, contractual duty, or third-party right.
- Submit false, misleading, fraudulent, infringing, defamatory, threatening, abusive, or unlawful information.
- Impersonate another person or misrepresent your authority or affiliation.
- Attempt to gain unauthorized access to the pages, connected systems, accounts, or data.
- Introduce malware, automated attacks, excessive traffic, or code intended to disrupt or damage a system.
- Scrape, harvest, compile, or use page content or personal information for an unauthorized commercial purpose.
- Use the pages or ESP content to reconstruct, imitate, or compete with ESP’s proprietary diagnostic methods or materials.
- Interfere with another person’s use of the pages or with their security or operation.
6. Information You Submit
You represent that information you submit through a marketing page is accurate, current, and lawfully provided. Do not submit Social Security numbers, financial-account credentials, tax returns, legal instruments, medical information, or other sensitive records through a public form. If ESP requests documents for a formal engagement, ESP will provide separate secure-intake instructions.
You retain ownership of information you submit. You authorize ESP and its service providers to receive, store, reproduce, transmit, and use that information only as reasonably necessary to respond to your request, operate the marketing pages, provide requested communications, protect the pages, comply with law, and carry out the purposes described in the Privacy Policy.
7. Electronic Communications
When you communicate with ESP electronically, you consent to receive responsive communications electronically. You agree that electronic notices, disclosures, and records satisfy any legal requirement that the communication be in writing, to the extent permitted by law. Consent to receive promotional email or SMS messages is governed by the specific consent language presented when you opt in and may be withdrawn as described in the message or in these Terms.
8. SMS Text Messaging Program
Program and Consent
ESP operates an SMS text messaging program for individuals who provide the consent required for the applicable messages. Consent may be collected through an optional checkbox that is not preselected, through a written request, or through another documented method permitted by law. Where both non-marketing and marketing text messages are offered, consent choices may be presented separately. Consent to receive marketing text messages is not a condition of purchasing or receiving ESP services.
Messages You May Receive
Depending on the consent you provide, ESP text messages may include appointment confirmations and reminders, rescheduling notices, replies to inquiries, customer-care communications, follow-up concerning a request or form submission, educational information, and marketing or promotional information about ESP’s services. Messages may be sent using automated technology where disclosed and permitted by law.
Message Frequency and Charges
Message frequency varies. Message and data rates may apply. ESP does not charge for the text messages, but your wireless provider may charge under your mobile plan.
How to Opt Out
You may cancel SMS messages at any time by replying STOP to a message from ESP. ESP may send one final message confirming that you have been unsubscribed. After that confirmation, you will receive no additional messages covered by the opt-out unless you later provide new consent.
Help
Reply HELP to a message for assistance or contact [email protected]. Support availability may vary, and text messaging is not monitored continuously.
Carrier Liability
Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on services outside ESP’s control, and ESP does not guarantee delivery.
Mobile Information
ESP will not sell, rent, share, or transfer mobile information or SMS opt-in data and consent to third parties or affiliates for their marketing or promotional purposes. ESP may disclose information to service providers or subcontractors solely as reasonably necessary to support ESP’s messaging program, customer service, communications, and related operations, subject to appropriate contractual and legal restrictions. Text messaging originator opt-in data and consent will not be shared with third parties for their own marketing or promotional purposes.
Privacy
ESP handles information associated with the SMS program as described in the Privacy Policy available at https://espdiagnostic.com/privacy-policy.
9. Third Party Services and Links
The marketing pages may use or link to third-party scheduling, communications, analytics, advertising, hosting, or other services. Third parties may apply their own terms and privacy policies. ESP does not control and is not responsible for third-party content, availability, security, or practices. A link or integration does not constitute ESP’s endorsement of every statement, product, or service offered by the third party.
10. Accuracy Availability and Changes
ESP seeks to present accurate and useful information, but public content may be incomplete, outdated, or affected by changes in law, tax rules, markets, underwriting, carrier practices, professional standards, or individual circumstances. ESP may correct errors and change content, features, availability, or descriptions without notice.
ESP does not guarantee uninterrupted or error-free access to a marketing page. Maintenance, security events, service-provider outages, Internet conditions, and other circumstances may interrupt availability.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE MARKETING PAGES AND PUBLIC CONTENT ARE PROVIDED AS IS AND AS AVAILABLE. ESP DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES RELATING TO THE PAGES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.
ESP DOES NOT WARRANT THAT THE PAGES WILL BE SECURE, UNINTERRUPTED, ERROR FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT PUBLIC CONTENT WILL BE COMPLETE OR SUITABLE FOR A PARTICULAR DECISION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ESP AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, PROFESSIONALS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL ARISING FROM OR RELATING TO USE OF OR INABILITY TO USE A PUBLIC MARKETING PAGE.
TO THE FULLEST EXTENT PERMITTED BY LAW, ESP’S TOTAL LIABILITY ARISING FROM OR RELATING TO PUBLIC WEBSITE USE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS OR THE AMOUNT YOU PAID ESP, IF ANY, SOLELY FOR ACCESS TO THE PUBLIC MARKETING PAGE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS LIMIT DOES NOT APPLY WHERE APPLICABLE LAW PROHIBITS IT OR TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless ESP and its owners, officers, employees, contractors, professionals, licensors, and service providers from claims, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from your unlawful use of the marketing pages, your material violation of these Terms, your infringement of another person’s rights, or information you submit without authority. ESP may control the defense of a matter subject to indemnification, and you agree to cooperate reasonably.
14. Suspension and Termination
ESP may restrict or terminate access to a marketing page when reasonably necessary to protect the pages, ESP, another person, or a legal or regulatory interest, or when ESP reasonably believes these Terms have been violated. Provisions that by their nature should survive termination will remain in effect, including intellectual-property, disclaimer, liability, indemnification, governing-law, and general provisions.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to applicable law, any court proceeding arising from these Terms or the public marketing pages must be brought in a state or federal court with jurisdiction over ESP’s principal place of business in California, and each party consents to that court’s personal jurisdiction and venue.
16. General Terms
These Terms and the Privacy Policy form the entire agreement between you and ESP concerning use of the public marketing pages, except that a separate written engagement agreement controls the professional services covered by that agreement. If a provision of these Terms is held unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
ESP’s failure to enforce a provision is not a waiver. You may not assign rights or obligations under these Terms without ESP’s prior written consent. ESP may assign these Terms in connection with a reorganization, merger, sale of assets, or other lawful business transaction.
17. Changes to These Terms
ESP may revise these Terms to reflect changes in the marketing pages, business practices, or legal requirements. The revised Terms will identify a new Last updated date. Your continued use of the pages after revised Terms are posted constitutes acceptance to the extent permitted by law.
